The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondents to issue him passport.

The petitioner was issued passport which expired on 27.01.2023. The petitioner applied for re-issuance of passport vide acknowledgment dated 16.03.2023. An FIR No. 96 dated 30.12.2018, under Sections 420, 467, 468 and 471 of IPC was registered against the petitioner at Police Station, Ranjit Avenue, Amritsar. The petitioner has preferred CRM-M- 2690 of 2022 before this Court seeking setting aside of aforestated FIR. The police after completing investigation has filed its report under Section 173 Cr.P.C., however, charges are yet to be framed. Learned counsel for the petitioner submits that respondents may be directed to re-issue his passport and it may directly be deposited with trial court.

Mr. Deepanjay Sharma, DAG, Punjab, on instructions from ASI Surjeet Singh, confirms the afore-stated factual position with respect to the aforesaid FIR.

Learned counsel for Union of India submits that respondents have no objection to re-issue passport if it is deposited with the trial court. 6.

In the wake of statements of both sides, the respondents are directed to issue passport to the petitioner subject to compliance of all the conditions prescribed under the Passport Act. The Passport Authority shall directly deposit the passport with trial court. 7.

The petition stand disposed of.
