* * * * KRISHNA MURARI, C.J. (ORAL) Petitioner has approached this Court challenging tender notice dated 16.07.2018 (Annexure P-8) inviting tenders for installation of open gym equipments at various locations. The main ground of challenge is that in pursuance to an earlier tender notice, petitioner was the lowest bidder and its tender was accepted, but no work order was granted to the petitioner and instead fresh tender notice had been issued. 2.
On being confronted, learned counsel for the petitioner has not been able to place before us any document or material which may even remotely indicate that the tender submitted by it in pursuance to the alleged earlier tender notice was ever accepted and any contract worth the name came into existence between the parties.

In the absence of any such document, the challenge made by the petitioner to tender notice dated 16.07.2018 on the grounds mentioned hereinabove is not liable to be entertained. We have also taken notice of the fact that in terms of AMODH SHARMA 2018.08.14 14:10 I attest to the accuracy and integrity of this document Chandigarh
CWP-19968-2018(O&M) subsequent tender notice dated 16.07.2018 (Annexure P-8), the date of opening the technical bid was 16.07.2018 and the financial bid was 27.07.2018. Learned counsel for the petitioner is not in a position to state before us any development which may have taken place after the opening of the financial bid.

The petition accordingly fails and stands dismissed. 5.
We, however, keep the right of the petitioner reserved to make application for recall of this order in case it is able to produce any document which may go to show that the alleged tender submitted by it was accepted and any contract between the parties came into existence.
