The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking direction to respondents to issue passport to the petitioner.

Learned counsel for the petitioner inter alia submits that FIR No. 67 dated 28.06.2018, under Sections 323, 324, 148 and 149 of IPC was registered against the petitioner at Police Station, Sadar Kapurthala. The petitioner has been found innocent. As on date, no criminal case is pending against the petitioner, thus, he is entitled to passport.

Mr. Arvind Seth, Senior Panel Counsel, who on advance notice is present in Court, submits that file of the petitioner has not been closed and as per his instructions, it would be processed within PARAMJIT KAUR SAINI 2023.07.25 16:47 I attest to the accuracy and authenticity of this order/judgment

CWP No. 15729 of 2023 -2- 2023:PHHC:093732 four weeks subject to filing of documents relating to FIR by the petitioner.

In view of statement of learned Senior Panel Counsel for Union of India, the petition stands disposed of with a direction to petitioner to submit documents relating to aforesaid FIR within two weeks from today and thereafter within four weeks, the respondent No. 3 shall decide fate of application of the petitioner, in accordance with law.
