**** Mr. Ranjit Singh Saini, LR of deceased-Kanta Devi (appellant), is present in person before this Lok Adalat. He submits that he has consent of his sisters regarding the release of the amount in his favour only. He has submitted an application "Mark-X" in this regard along with an undertaking that in the event of the other Class-I heirs i.e., the sister raises any claim, he shall be liable to disburse their proportionate shares of the Award. As agreed, as per statement of learned counsel for the appellants, learned counsel and representatives of the Insurance Company, (separately recorded), a sum of Rs. 9,99,000/- (Rupees Nine Lakh Ninety Nine Thousand only) over and above, the amount awarded by the Tribunal is allowed to the appellants, in full and final settlement of the claim in this appeal.
As per the statement of learned counsel for the appellants the enhanced amount would be paid to Mr. Ranjit Singh Saini S/o Dalip Singh Saini, LR of deceased-Ms. Kanta Devi. Accordingly, we dispose of this case with a direction to the Insurance Company to deposit a crossed-cheque for Rs. 9,99,000/- (Rupees Nine Lakh Ninety Nine Thousand only) in the name of Ranjit Singh Saini with the office of the Lok Adalat of the High Court within a period of 45 days in compliance of this order, failing which, interest @ 9% interest p.a. shall follow KUSUM 2023.11.30 18:24 I attest to the accuracy and authenticity of this order/judgment Punjab & Haryana High Court, CHD on this amount till the payment from the date of this order.
BI-MONTHLY LOK ADALAT FAO-3983-2011 (O&M) 2023:PHHC:146644 Officer of the Lok Adalat Branch/office shall issue proper receipt after receiving the cheque to learned counsel/representatives of the Insurance Companyrespondent. The appellant(s)' counsel may collect the cheque from the office of the Lok Adalat.
All pending miscellaneous application(s), if any, are also disposed of.
Copy of the order/statement be supplied /sent to the counsel/parties and file be returned to the High Court.
