RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for issuance of direction to the respondents to deliver the vacant possession of the premises/land shown in the site plan (p-6) comprised in Khewat No.140/125, Khatoni No.478, khasra No.75//13/3 (1-0) situated in village Killi Nihal Singh, Hadbast No.179, Tehsil and District Bathinda, who are occupying the same illegally and unauthorizedly. It is further prayed that a direction be issued to the respondents to pay the compensation for utilizing the abovesaid premises/land till the delivery of the same to the petitioner. Notice in this case was issued and the State was directed to carry out the demarcation for redressal of the grievances of the petitioner as prayed for by him.
In response to the same, reply has been filed by way of affidavit of Showkat Ahmad Parray, District Collector Bathinda. Learned State counsel has invited the attention of this Court to the report of demarcation. It has been submitted that on the basis of the demarcation MEENU 2023.12.
CWP-26303-2015 -22023:PHHC:159518 report, it is found that Police Post Killi Nihal Singh wala is constructed in Khasra No.75//12/2 min area of Government of India. It has been submitted that thus it is found that police post is not constructed in the land of the petitioner.
Learned counsel for the petitioner however submits that demarcation report is not in accordance with law. Be that as it may, the present petition is disposed of in view of the submissions made by learned State counsel and the reply/affidavit of District Collector, Bathinda..
However, petitioner would be at liberty to pursue his remedies in case any cause of action survives.
