(Oral) By way of present writ petition, petitioner is seeking issuance of writ in the nature of mandamus directing the respondents to release the salary w.e.f 27.06.2014 to 22.07.2014 or in the alternative to take action on the representation dated 22.07.2014 and further prayer is to grant him upgraded functional grade pay and 1st ACP on completion of 8 years regular service.

On notice, a written statement has been filed by respondent Nos. 1 to 3 stating that the salary of the petitioner w.e.f 27.06.2014 to 21.07.2014 has been released vide Annexure R-1 and he has been granted upgraded functional grade pay vide Annexure R-2. C.W.P No. 2535 of 2016 -2With regard to 3rd prayer of the petitioner that he be granted 1st ACP on completion of 8 years, it has been stated that it will be granted to him on outcome of the disciplinary proceedings pending against him under Rule 7 of Haryana Civil Services (Punishment and Appeal) Rules in three cases.

In view of the above factual position, the present petition is being disposed of with a direction to the respondents to conclude the proceedings pending against him, in accordance with law and thereafter consider his claim.
