(ORAL) This petition has been filed challenging the order dated 06.08.2018 cancelling the enlistment of the petitioner as contractor by the respondents on the allegation that the impugned order is in violation of the principles of natural justice, inasmuch as neither any show cause notice was given, nor any opportunity of hearing was provided. Vide order dated 13.08.2018, we required the learned Assistant Advocate General, Punjab, who accepted notice, to seek instructions in the matter.

Today, we are informed, on the basis of instructions from Mr. Brinder Pal Singh, Superintending Engineer Department Water Resources, Punjab, that the impugned order is in the process of being withdrawn and a fresh process would be undertaken after issuing show cause notice and providing opportunity of hearing to the petitioner and, thus, liberty has AMODH SHARMA 2018.08.17 12:07 I attest to the accuracy and integrity of this document

CWP-20066-2018(O&M) been prayed for from this Court to pass fresh orders in this regard.

In view of the aforesaid statement made before us by learned Assistant Advocate General, Punjab that the impugned order is in the process of being withdrawn and de-novo process would be undertaken after issuing show cause notice and providing opportunity of hearing to the petitioner, no ground survives in this petition.

The writ petition is accordingly disposed of with a direction to the respondents that the impugned order shall be withdrawn within two days from today and thereafter entire exercise of issuing show cause notice and providing opportunity of hearing to the petitioner shall be carried out within a period of three weeks from today.
