Mr. Sandeep Singh Josan, Advocate, for respondent No.6. ****         This petition relates to issuance of membership to the petitioners as regards entering their names in the voter list for the elections to the post of office bearers of Bar Association of Nihal Singh Wala, District Moga, Punjab. Learned counsel for the Bar Association of Nihal Singh Wala submits, at the outset, that as far as the issue regarding the elections of Bar Association for the year 2020 is concerned, the petition has been rendered infructuous and the same may be disposed of as such.

However, as far as the procedure for the purposes of conducting elections and preparing final voter list for the elections of Bar Association(s) is concerned, the Bar Council of Punjab and Haryana has issued a fresh notification dated 15.09.2022, which postulates the procedure and rules for dealing with all such issues. And, in case any issue, as has been raised in this petition, arises for consideration, the petitioners would be at liberty to approach the competent authority, in RAVINDER SHARMA 2022.09.

 



  [2] accordance with the Rules and Procedures envisaged in the notification . He submits that in case the petitioners apply afresh by filing a representation, the Bar Association of Nihal Singh Wala shall consider and decide the same, in accordance with law.

Per contra, learned counsel for the petitioners submits that the petitioners have already moved the Bar Association as regards obtaining membership of the Bar Association, vide representation/application, dated 29.10.2020 (PE4), but the same has failed to evoke any response. It is urged that a fresh representation/application to be submitted by the petitioners ought to be considered and decided in continuation with their representation(s)/applications , for the petitioners have been pursuing their cause for the last two years.

To this, learned counsel for the Bar Association submits that in the event the petitioners apply afresh by way of a representation/application, the competent authority shall consider and decide the same, in accordance with law, and also taking into consideration their representation/application . In view of the aforesaid statements made by learned counsel for the parties and taking the same on record, the petition is disposed of as having been rendered infructuous, with liberty to the petitioners to approach the competent authority, as indicated above.
