Mr. Sunny Singla, Advocate for the petitioner. Mr. Deepak Gupta, Advocate for respondent No.1. NAMIT KUMAR J. (Oral) Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing of order dated 07.11.2015 (Annexure P-2) and order dated 01.08.2022 (Annexure P-5) whereby recovery has been initiated from the petitioner, who is LR of the deceased employee. Further prayer has been made to stay the operation of order dated 07.11.2015 (Annexure P-2) and order dated 01.08.2022 (Annexure P-5). Another prayer has also been made to issue direction to the respondents - authorities to release all the retiral benefits to the petitioner along with interest @ 12% per annum.

After arguing the case for some time, learned counsel for the petitioner wishes to withdraw the present petition with liberty to enable him to defend the civil suit filed by the respondents seeking recovery of the amount mentioned in Annexures P-2 and P-5. Dismissed as withdrawn with aforesaid liberty. (NAMIT KUMAR) JUDGE 19.07.
