(ORAL) Learned counsel for respondent No.1 submits that appellant has since expired during pendency of the appeal and per his instructions his client i.e. respondent No.1-Sant Ram, is the sole Legal Representative, being real brother of the appellant. It is further pleaded that the appellant was unmarried. On a Court query, he submits that another brother of the appellant had since pre-deceased him while daughter of the pre-deceased brother was proceeded ex parte in the civil suit. In the premise, it appears that the proceedings before this Court are rendered infructuous. The appeal is accordingly disposed of as such with liberty to file appropriate application in case any cause of action survives and/or any of the family members of deceased appellant has any grievance.
