(Oral) Learned counsel for the respondents has produced a communication dated 07.11.2017, wherein, it has been stated that the Show Cause Notice No.13/DC/CE/BGH/2016-17, dated 07.06.2016, which has been impugned in the present writ petition has been withdrawn and the refund amounting to `37,34,995/- has been sanctioned to the petitioner vide Cheque No. '657724', dated 07.11.2017. The aforesaid communication is taken on record, subject to all just exceptions. 2.
In view of the above, learned counsel for the petitioner states that the present writ petition has been rendered infructuous and may be disposed of as such.
