DEEPAK GUPTA , J.(Oral) Prayer in this petition filed under Section 482 Cr.P.C. is to issue directions to respondent Nos.2 to 4 to conduct fair and proper investigation in case FIR No.399, dated 23.09.2022, under Section 346 IPC (Sections 302 and 34 IPC added later on), registered at Police Station Sadar Tauru, District Nuh.

As per status report filed earlier by the respondent-State, after completion of investigation, final report under Section 173 Cr.P.C. has already been filed before learned Area Magistrate and the next date of hearing is 06.09.2023 at the stage of prosecution evidence. Contention of learned counsel for the petitioner is that some of the accused have not been arraigned as such by the respondent-State. Considering the fact that investigation is already complete and case is at the stage of prosecution evidence, this petition is disposed of with liberty to the petitioner to move necessary application under Section 319 Cr.P.C. at appropriate stage. If any such application is filed, the Trial Court shall deal with the same, in accordance with law.
