Mr. B.S. Saroha, Advocate, for respondents No.6 to 8. ***** PARAMJEET SINGH, J. (ORAL) Instant writ petition under Articles 226/227 of the Constitution of India has been filed for issuance of a direction to respondents No.1 to 3 to take appropriate action against respondent No.6 for embezzlement of old age pension and widow pension. Further prayer is for direction to respondent No.5 to get FIR registered against respondents No.6 to 8 for the embezzlement of Government funds.

I need not narrate entire facts as only allegation against respondent No.6, Sarpanch of the village, is that she has misappropriated the old-age and widow pension by showing disbursement thereof in the names of persons who were already dead. -2CWP No.2806 of 2014 held vide enqiury report dated 04.02.2013 (Annexure P-5) that two Panches, namely, Satpal and Mahabir were responsible for embezzlement as they were authorized to disburse old-age and widow pension vide resolution dated 11.08.2010. Thereafter, competent authority vide order dated 22.04.2013 expelled Satpal and Mahabir holding them responsible for embezzlement and exonerated respondent No.6. Otherwise also, it is stated by learned State counsel that entire amount has been paid. In view of this, first prayer has become infructuous.

So far as second prayer is concerned, petitioner will be at liberty to avail remedies in accordance with law. Disposed of.
