Rajan v. State Of Haryana And Others
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH.
Crl. Misc. No.M-32371 of 2019 (O&M) Date of Decision: July 31, 2019 Rajan ..........PETITIONER(s).
VERSUS
State of Haryana and others ........RESPONDENT(s).
CORAM:- HON'BLE MR. JUSTICE SURINDER GUPTA
Present:
None.
******* SURINDER GUPTA, J.(Oral) As per representation (Annexure P-4), petitioner claimed to have inherited the share of Mohan Lal son of Lal Singh on the basis of his Will and later sold it to M/s Mewar Cultivation Co., Lattowali Gali, Alankar Vihar, Kankhal, Haridwar (Uttrakhand) through Parmod Kumar son of Jawahar Lal. Now said Parmod Kumar is claiming that Mohan Lal had already sold his share in the year 1999 and police is harassing the petitioner on the complaint of Parmod Kumar.
There appears to be property dispute between the parties for which they can avail remedy before the Civil Courts. However, in case of any fraud and offence has been committed by the petitioner, police is competent to take action in the matter.
Without expressing any opinion on merits, this petition is disposed of with direction to respondent No.2-Commissioner of Police, Faridabad to look into grievance of petitioner relating to her harassment by the police and take appropriate action in accordance with law. However, it is made clear that the above order will not be interpreted as providing protection to the petitioner from any action taken in any civil, criminal or any other proceedings initiated/pending against him in accordance with law.
