Through instant petition, preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to make pending payment of 2nd bill of Rs.21,38,634/- for work of providing and fixing road furniture on the main road A, C & D allotted vide letter No.78/EEA dt. 07.10.2016 with time limit of two months demanded vide invoice No.T-89 dated 13.03.2018 (P-2) along with interest @ 18% p.a..

Learned counsel for the petitioner contends that though legal notice dated 14.05.2018 (P-3) was duly served upon respondent No.2 but till date neither any reply to the said legal notice has been received nor any final order has been passed by the respondent(s).

Learned counsel for the petitioner further submits that petitioner feels satisfied in case a direction is issued to respondent(s) to decide legal notice (P-3) in a time bound manner.

Instant petition is disposed of with a direction to respondents to look into the grievances unfolded by the petitioner in legal notice (P-3) and take a conscious decision, within a period of three months from the date of receipt of a certified copy of this order. If the concerned authority comes to the conclusion that petitioner is entitled to the relief claimed through legal notice (P-3), to make the payment within a period of next 45 days. 5.
