(ORAL) This Court in pre-lunch session had disposed of the writ petition with a direction to the Financial Commissioner to decide the application (Annexure P-9) for adjourning the ROR sine die owing to the pendency of the civil suit in the following manner. Learned counsel for the petitioner submits that she will be satisfied if a direction is issued to the Financial Commissioner, Revenue, Punjab to decide the application dated 06.12.2016 (Annexure P-9) within a stipulated period.

Without going into the merits and demerits of the claim of the petitioner, I deem it appropriate to direct the Financial Commissioner, Revenue, Punjab to consider the application dated 06.12.2016 (Annexure P9) filed by the petitioner within a period two weeks from the date of receipt of certified copy of this order and shall pass a speaking order thereon. Ms. Sushma Chopra, learned counsel for the petitioner, in postlunch session, submits that application under Section 117 of the Punjab Land Revenue Act had not been heard and rather heard the main case on pending ROR on merits.

CWP No.2192 of 2017 -2In view of the peculiar facts and circumstances of the case, I deem it appropriate that one effective opportunity of hearing in respect of application under Section 117 of the Punjab Land Revenue Act shall be given to the parties and thereafter, the same shall be decided first before hearing the arguments on pending ROR in the time-frame already indicated. The writ petition stands disposed of with the above direction.
