Seeking custody of his daughter, the father has come up before this Court by filing a criminal writ petition in the nature of habeas corpus. 2.

Notices served upon the official respondents through the State's counsel. Given the nature of the order, this Court proposes to pass, neither the response of official respondents is required nor exists any requirement to issue notices to the private respondents.

On instructions, counsel for the State submits that the detenue's age is 18 years & 02 months and as per information collected from co-villagers, she has eloped with a boy of same village, who is also above 18 years of age and FIR No.106 dated 16.07.2023 to that effect has already been registered. State counsel further submits that as per the investigation, their last phone location was located in Uttrakhand and police is trying to recover the girl.

Given above, as and when the detenue is traced, she will be produced before the nearest female Judicial Magistrate and in case the time is not suitable immediately before Nari Niketan Center and after that produce her before the concerned Judicial Magistrate. The concerned Judicial Magistrate shall interact with her and it is the concerned Magistrate's discretion whether to record her statement under Section 164 Cr.P.C or to proceed without that and after that pass appropriate orders because the girl is adult.
