Learned counsel for the petitioner submits that the liability, which has been imposed upon the petitioner is for the period starting from December 2001 to December 2004, though, after purchasing the business for the period starting from 01.04.2003 onwards upto December 2004, the liability has already been discharged by the petitioner. Learned counsel for the petitioner further submits that as the notices were issued to respondent No.2, no effective opportunity was given to the petitioner to bring the correct facts to the notice of the authorities concerned and in the present case, the imposition of the liability by authorities concerned is overlapping, which fact has not been considered by the authorities concerned. Learned counsel appearing on behalf of respondent No.1 submits that in case any representation is filed by the petitioner showing that any liability which has been fastened by the impugned orders, has already been discharged by the petitioner so as to reduce the amount of liability already deposited under the new EPF Number, the same will be examined and appropriate order will be passed within a period of three months of the receipt of any such claims at the hands of the petitioner. 3.

Learned counsel for the petitioner submits that the present petition may kindly be disposed of having not pressed with liberty to approach the respondents by filing appropriate representation bringing to their notice the correct facts so as to reduce the liability of the petitioner. 4.

Ordered accordingly.

It may be noticed that any amount deposited by the petitioner during the pendency of the present petition will be taken into account while calculating the liability of the petitioner and the same will be adjusted in accordance with law.
