The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioners, in case FIR No.137 dated 28.07.2020 registered under Sections 380/34 IPC at Police Station Kotwali, District Bathinda.

Vide order dated 09.11.2020, petitioners were granted the concession of anticipatory bail in the following terms:- "Counsel for the petitioners inter alia contends that both the petitioners have been falsely involved in the present case on the basis of supplementary statement of complainant Vijay Kumar dated 6.10.2020 alleging therein that Samma handed over the gold ornaments to the petitioners who further sold the same to jewellers namely Suraj Chawla and Rajinder Kumar @ Bittu and main accused Jatinder has already been granted anticipatory bail by a coordinate bench of this court. The case is triable by the Magistrate and the petitioners are ready and willing to join the investigation."

CRM-M-36734-2020 -22023:PHHC:049173 Learned counsel for the petitioners submits that in compliance of abovesaid order, the petitioners joined the investigation. This fact is not disputed by the State counsel as well.

Learned State counsel on instructions states that pursuant to order dated 09.11.2020, passed by this Court, the petitioners have joined the investigation and are no longer required for further interrogation. In view of the above, the petition is allowed and interim order dated 09.11.2020, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
