Learned counsel submits that the petitioner was appointed as Junior Engineer in the year 2008 on contract basis and has been uninterruptedly continuing as such. He is entitled for regularization in terms of the Notification dated 24.01.2023, issued in compliance to the judgment passed in Balbir Singh and others vs. State of Punjab and others, CWP7764-2015 and connected cases, decided on 04.12.2018, against which LPA has been dismissed on 29.03.2022. However, his claim is not being considered despite a legal notice dated 23.04.2025, Annexure P-6 has been served upon the respondents, which has yet not evoked any response. He, on instructions, states that in case, the Government comes to the conclusion with regard to there being any delay which though there is none, his arrears in terms of the judgments in Saroj Kumari vs.

State of Punjab 1998(3) SCT 664 and Union of India and others vs. Tarsem Singh 2008(4) SCT 19 can be restricted to 38 months and prays that his claim may be considered in a time bound manner, to which learned State counsel has no objection. HAMANT 2025.07.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the legal notice dated 23.04.2025, Annexure P-6, taking note of the aforesaid judgments within a period of 4 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
