In the present writ petition, the petitioners have challenged the order dated 05.05.2026 (Annexure P-5) passed by respondent No.2 vide which, the claim of the petitioners for permanent absorption in District Police (General Cadre) as per the Haryana Police (Permanent Absorption of India Reserve Battalion's Police Personnel in District Police General Cadre Rules, 2024 (hereinafter referred to as '2024 Rules') has not been considered as no vacancy was notified and it was observed therein that the same would be considered as soon as the draft of Haryana Indian Reserve Police Service Rules, 2026 are notified and recruitment process in IRBs is completed. 2.

The brief facts of the case are that the petitioners were directly appointed as Constables in India Reserve Battalions (IRB) and are presently working as Head Constables and Exemptee Head Constables in India Reserve Battalions, Bhondsi, Gurugram, Haryana. It transpires that the

petitioners have completed more than 15 years of service in India Reserve Battalions (IRB).

Learned counsel appearing on behalf of the petitioners submits that in light of 2024 Rules, the petitioners are entitled for absorption in District Police (General Cadre), as they have completed more than 15 years of satisfactory service, including completion of their Phase-1 and Phase-II training. Learned counsel further submits that as the petitioners fulfill the eligibility criteria prescribed for absorption in District Police (General Cadre), the petitioners have a right to be absorbed in District Police (General Cadre).

Learned counsel appearing on behalf of respondents submits that a perusal of 2024 Rules would show that mere eligibility of the petitioners for permanent absorption in District Police (General Cadre) does not confer any vested right upon the Police Personnel of India Reserve Battalions to claim absorption in District Police (General Cadre). Learned counsel further submits that a perusal of the impugned order would also show that there is a valid reason for not absorbing the petitioners in District Police (General Cadre) after completion of 15 years of service in India Reserve Battalions.

After hearing learned counsel for the parties at some length, the issue involved in the present writ petition is as to whether, the petitioners are entitled to permanent absorption in District Police (General Cadre) upon completion of 15 years of satisfactory service in terms of 2024 Rules. 6.

A perusal of the facts of the case would show that it is not in dispute that the petitioners have completed more than 15 years of service in

India Reserve Battalions. The 2024 Rules merely provide that Police Personnel in India Reserve Battalions only become eligible for permanent absorption in District Police (General Cadre) after completion of 15 years of satisfactory service and the Director General of Police, Haryana, shall notify the number of vacancies to be filled amongst the Police Personnel for the purpose of permanent absorption in District Police (General Cadre). In terms of the above said 2024 Rules, the petitioners are only eligible for permanent absorption in District Police (General Cadre) and do not have any vested right to claim absorption in District Police (General Cadre) after completion of 15 years of service.

A perusal of the impugned order dated 05.05.2026 (Annexure P-5) would further show that there is an acute shortage in the IRB Battalions and in order to maintain minimum strength of State Disaster Response Force (SDRF) and IRB, no vacancy has been notified for absorption of IRB Personnel in District Police (General Cadre) for the year 2025 and 2026. A perusal of the above said facts would show that there is a valid reason for not notifying the vacancies for absorption of IRB Personnel in District Police (General Cadre).
