JASWANT SINGH, J (ORAL) The petitioners, who were appointed as Conductors by the respondent-PRTC, have invoked the jurisdiction of this Court under Article 226 of Constitution seeking quashing of order dated 22.6.2016 (P.2) passed by the respondent whereby their promotion orders dated 21.6.2016 (P.1) has been recalled with further directions to respondents to release all the benefits arising out of order (P.1).

Upon notice, an Additional affidavit dated 24.4.2017 of M.S. Narang, Managing Director, PRTC, Patiala has been filed on behalf of the respondent deposing that in pursuance of the DPC held on 21.10.2016, respondent No.4 was promoted vide order dated 25.10.2016 while petitioner Nos.1 to 3 could not be promoted because of their bad service record. However, it is averred that now the respondent-Corporation on reconsideration has implemented order dated 21.6.2016 (P.1) vide which the

CWP No.25594 of 2016 #2# petitioners were earlier promoted, in pursuant to the DPC held on 16.6.2016, thereby rendering the present petition infructuous. Learned counsel for the petitioner has not disputed the aforesaid fact.

Dismissed as having become infructuous.
