The instant petition has been filed on behalf of the petitioner seeking grant of anticipatory bail in respect of aforementioned FIR. 2.

On 6.8.2024, the following order was passed by this Court:- "Learned counsel for the petitioner submitted that the matter infact arises out of a land dispute between the petitioner's family and complainant's family and that as of now the Civil Court has already decided the matter in favour of complainant's family and that it is only the matter pertaining to partition and division, which is pending before the Tehsildar.

CRM-M-33938-2024 (O&M) ( 2 ) Learned counsel for the petitioner submitted that the petitioner is willing to amicably resolve the matter on reasonable terms and will not raise any dispute. It has been submitted that the parties may be referred to Mediation and Conciliation Center of this Court. List again on 29.8.2024.

Petitioner's father namely Sushil Kumar or any other responsible person from his family as well as complainant Vinod Kumar son of Ram Narayan are directed to appear before Mediation and Conciliation Center of this Court on 14.8.2024." 3.

Report of Mediation and Conciliation Center of this Court has been received as per which the matter has been resolved amongst the parties. 4.

At this stage, Mr. Sarun Hans, Advocate has put in appearance on behalf of the complainant and has filed Vakalatnama, which is taken on record. He has endorsed the factum of compromise and has stated that he has no objection in case the petitioner is granted bail.

Having regard to the facts and circumstances of the case particularly the fact that the matter is stated to have resolved amongst the parties, the instant petition is allowed and the petitioner, in the event of his arrest, is ordered to be released on bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
