Petitioner has approached this Court by way of instant writ petition filed under Articles 226/227 of the Constitution of India inter-alia for issuance of a writ in the nature of mandamus directing the respondents to refund the amount deposited in connection with a plot in Societyrespondent No.4. Another direction has been sought to respondent No.4 to refund the amount with interest and to take a final decision on the representation dated 12.08.2022, Annexure P-15. 2.

Notice was issued to the respondents on 06.03.2024. 3.

Despite grant of opportunities, no response has been filed. 4.

A perusal of the writ petition shows that the representations, KAMAL SHARMA 2024.11.04 17:16 I attest to the accuracy and authenticity of this order/judgment High Court, Chandigarh.

CWP-15773-2023 -2Annexures P-15 and P-17, respectively, had been addressed to the Deputy Registrar, Cooperative Societies, Gurugram and to the Registrar, Cooperative Societies Haryana, Panchkula. It is an undisputed case of the petitioner that the amount was deposited with Society-respondent No.4 and refund, if any, has to be given by the said Society. Addressing of representation to the official respondents is meaningless and petitioner has not approached respondent No.4. Therefore, the prayer made in the petition cannot be acceded to.

Liberty is granted to the petitioner to move an appropriate application/representation to respondent No.4. In case, such an application/representation is made within a period of four weeks from today, respondent No.4 shall examine it and pass an appropriate order within a period of three months thereafter.

Petition is disposed of.
