(ORAL) Petitioners-tenant-Bank has filed this revision against the judgment of Appellate Authority dated 10.05.2019, dismissing its appeal, affirming the order of learned Rent Controller dated 30.03.2017 whereby petitioners-Bank was directed to make payment of arrears of rent amounting to ` 7,86,694, to the respondent within a period of three months from the date of order.

On instructions from Sh. Jayant Mangla, Branch Manager, State Bank of India, Railway Station Branch, Ludhiana, learned counsel for the petitioners submits that she does not challenge the judgment and order of the authorities below on merits, however, seeks three months' time to vacate the demised premises.

In view of above request, petitioners are granted three months' time from today to vacate the demised premises, subject to RISHU KATARIA 2019.09.17 12:57 I attest to the accuracy and integrity of this document

CR-5471-2019 (O&M) -2deposit of up-to-date arrears of rent within a period of two weeks from today. In case, petitioners do not vacate the demised premises within three months from today, they shall pay mesne profits at the rate duly fixed by the learned Rent Controller and upheld by the Appellate Authority, failing which the same shall be recoverable from its movable and immovable assets, whatsoever. Petitioners are directed to file affidavit in this respect before the executing Court within two weeks from today.

It is, however, made clear that in case, this order is not complied with by the revisionists in its letter and spirit qua payment of arrears of rent, in that eventuality, Executing Court shall proceed with the execution and take all positive steps to get the demised premises vacated from him along with recovery of use and occupation charges aforesaid. Disposed of.
