Petitioner seeks a writ in the nature of mandamus to release payment of `47,38,713/- stated to be outstanding amount for the work allotted.

At the outset learned State counsel submits that matter shall be examined by respondent no. 2 whether same can be referred to Arbitration in view of agreement, if any, between the parties. In view of above, no further direction is necessary. Disposed of.

It is made clear that in case Arbitration is not possible, petitioner shall be at liberty to avail appropriate remedy before the civil court.
