The petitioner retired from service as Store Keeper from the office of Controler of Stores, DHBVNL, Hisar on 3.5.2002. Vide order dated 15.3.2011, the petitioner was allowed 2nd ACP Scale of Store Munshi with effect from 1.8.2000( on completion of 20 years regular satisfactory services). He was also allowed first higher Standard Pay Scale w.e.f. 10.01.1994. The petitioner sent representation dated 17.11.2014 for grant of 2nd Modified ACP Scale i.e. Rs.5450-150-6950-EB-150-8000 relying on office order dated 23.2.2004 (Annexure P-2). The case of the petitioner for grant of 2nd Modified ACP Scale was forwarded by the Senior Accounts Office, Controller of Stores, DHBVN, Hisar to the Senior Engineer, DHBVN, Hisar on 8.6.2015.

CWP-26602-2015 -2The petitioner has also submitted Justice Demand Notices (Annexure P-5) for grant of 2nd Modified ACP Scale, but no action has been taken thereon so far.
Learned counsel for the petitioner states that at this he would be satisfied if a direction is issued to respondent No.4 to take a decision on the claim of the petitioner for grant of 2nd Modified ACP Scale dated 1.9.2015 (Annexure P-5) as contained in his Justice Demand Notices followed by supplementary notice dated 19.11.2015 (Annexure P-8).
Without commenting on the merits of the case, this writ petition is disposed of with a direction to respondent No.2 to take a decision on the claim of the petitioner for grant of 2nd Modified ACP Scale as contained in the Justice Demand Notices dated 1.9.2015 (Annexure P-5) followed by supplementary notice dated 19.11.2015 (Annexure P-8) expeditiously, preferably within a period of three months from the date of receipt of certified copy of this order.
