Dated Police Station Section/s 22.5.2024 Zirakpur, District SAS Nagar, Mohali 307, 325, 379-B, 341, 201 and 34 of Indian Penal Code, wherein offences under Sections 325 and 201 IPC were added later on GURVINDER SINGH GILL, J. (Oral) CRM-42295-2024 In view of the reasons mentioned in the application, the same is allowed as prayed for and the amended petition annexed with the application is taken on record.

CRM-M-34336-2024 (Main Case) 1.

The petitioner seeks grant of regular bail in respect of the aforementioned FIR.

The FIR was lodged at the instance of Sandeep Walia, wherein it is alleged that three persons had way-laid him while he was going on a motorcycle and had inflicted injuries.

Learned counsel for the petitioner submitted that the FIR came to be lodged falsely on account of some misunderstanding, which has now been resolved and the matter has been amicably settled amongst the parties. It has further been submitted that the petitioner, in any case, has been behind since the last about 5 months and 13 days and otherwise has a clean record. 4.

Mr. Nikhil Anand, Advocate, learned counsel representing the complainant has endorsed the factum of compromise and has stated that the complainant has no objection in case the petitioner is granted bail. 5.

Learned State counsel has filed custody certificate of the petitioner indicating that the petitioner has been behind bars since the last more than 5 months and has a clean record. The custody certificate is taken on record. 6.

In view of the aforestated position, wherein the matter is stated to have been amicably resolved amongst the parties and the petitioner otherwise has a clean record, further detention of the petitioner would not be justified. 7.
