(ORAL) The present petition has been filed by the petitioner under Section 439 of the Cr.P.C., seeking regular bail in case FIR No.40 dated 18.04.2017, under Section 302 IPC (Challan presented under Section 302/34 IPC and charges framed under Sections 302/382/460 and 34 IPC), registered at Police Station City Rampura, District Bathinda. 2.

Learned Deputy Advocate General, Punjab, opposes the prayer of the petitioner by submitting that the trial is virtually at the fag end inasmuch as the entire evidence from the prosecution side has already been completed and even the accused persons have been examined under Section 313 of the Cr.P.C., after which the matter is now fixed for 27.11.2020 for defence evidence, if any, and arguments.

In this view of the matter, this Court finds no justification to release the petitioner at this stage, considering the gravity of the offence involved. The application is, therefore, dismissed, however with a direction to the Learned trial court to make every endeavour to complete the trial as expeditiously as possible and preferably within a period of three months from the date of communication of this order. It is further clarified that in case, there is any delay on the part of the defence in examining any witness from their side, the trial court would be at liberty to close the defence evidence considering the overall situation.
