VINOD KUMAR 2016.05.18 15:13 I attest to the accuracy and authenticity of this document Chandigarh
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No.26618 of 2015 Date of decision:17.05.2016 Sangeeta
...Petitioner
Versus
State of Haryana and others
...Respondents
CORAM: Hon'ble Mr. Justice Rakesh Kumar Jain
Present:
Mr. S.K.Liberhan, Advocate, for the petitioner.
***** Rakesh Kumar Jain, J.
The petitioner was initially married to one Manoj Kumar, thereafter Surender and now she is the wife of one Sachin Walia. An ex-parte decree for divorce has been passed against the petitioner on 27.09.2012 in which she was proceeded against ex-parte on 22.02.2012. She filed FAO No.M-1 of 2015 which was dismissed as withdrawn on 21.01.2015 as the petitioner was granted liberty to file an application for setting aside the ex-parte judgment and decree dated 27.09.2012. Counsel for the petitioner has failed to make out any case as the petitioner has not applied for maintenance before the Court below. Thus, the present petition is not maintainable at least for the award of maintenance.
Dismissed.
