JASGURPREET SINGH PURI , J. (ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in FIR No.140 dated 2.7.2020, under Section 306 IPC, registered at Police Station Nathusarai Chopta, District Sirsa.
It has been submitted by the learned counsel for the petitioner that it is a case where the FIR has been lodged against the petitioner under Section 306 IPC and even as per the contents of the FIR itself the ingredients of Section 306 IPC, are not fulfilled. CRM-M-36695-2020 (O&M) submitted that even as per the suicide note, the ingredients of Section 306 IPC, are not fulfilled.
On 9.11.2020, notice of motion was issued by this Court and in the meanwhile, the petitioners were granted interim protection subject to their joining investigation and complying with the provisions of Section 438 (2) Cr.P.C.
Today, learned State counsel, on instructions from SI Satbir Singh, has stated that in the present case in pursuance of the order of this Court dated 9.11.2020, both the petitioners have joined investigation and have fully cooperated with the investigation process. He has further submitted that the petitioners are no longer required for custodial interrogation.
In view of above statement made by the learned State counsel, the present petition is allowed. Interim order dated 9.11.2020, is hereby made absolute.
