JASWANT SINGH, J. (ORAL) The petitioner is serving as Warehouse Manager with the Punjab State Warehouse Corporation. Charge sheet dated 6.8.2015 (Annexure P20) was issued, inter alia, for having caused loss to the extent of Rs.65,49,724/-, to the Corporation on account of FCI having deducted carry over charges of wheat stocks of the crop year 18th November, 2010 to 18th March, 2011.

An enquiry report dated 26.10.2016 stands submitted returning findings against the present petitioner. He has been issued a show cause notice dated 17.11.2016 (Annexure P21), seeking to inflict the RAJ KUMAR ARORA 2018.11.20 10:38 I attest to the accuracy and integrity of this document

CWP-20415-2018 (O&M) proposed penalty. Admittedly, no penalty has been imposed till today with respect to the said show cause notice.

By filing the instant petition, the petitioner, in sum and substance, seeks quashing of aforesaid charge sheet (Annexure P20) and is trying to pre-empt any penalty to be imposed pursuant to the show cause notice.

At the outset, counsel for the petitioner, on instructions from his client, prays for permission to withdraw the instant writ petition to raise his pleas before the authorities concerned. Dismissed as withdrawn with above said liberty. (JASWANT SINGH) JUDGE November 17, 2018.
