HARINDER SINGH SIDHU, J The petitioner has assailed order dated 24.01.2018 passed by the learned Judge, Special Court, Ludhiana, declaring him as proclaimed offender in case FIR No.0063 dated 07.04.2016 under Section 18 of NDPS Act registered at P.S GRP Ludhiana, District Govt Rly Police (Ludhiana). It is stated that initially, the petitioner was granted bail by the trial Court. However, on 18.01.2017, the petitioner did not cause his appearance in the said case and his bail bonds and surety bonds were cancelled. Later he was declared as proclaimed offender vide the impugned order.
Learned counsel for the petitioner states that his nonappearance was not intentional. Due to certain compelling circumstances, he could not appear on the date fixed. He undertakes that the petitioner shall appear before the learned trial Court on any date to be fixed by this Court.

CRM-M-41273 of 2021 (O&M) #2# account the facts of the present case, this petition is disposed of with the observation that the petitioner may appear before the learned trial Court on or before 10.11.2021. On his doing so, he shall be enlarged on bail by the trial Court subject to his furnishing bail bonds and surety bonds to its satisfaction. He shall also file an undertaking before the concerned Court to continue appearing as and when required apart from following all the terms and conditions fixed in this respect.
