Prayer in this writ petition is for quashing of order dated 16.09.2005 as well as order dated 12.05.2007 passed by the respondent-Bank. Undisputedly, petitioner has earlier approached this Court by way of CWP No.4688 of 2012 which was dismissed on 03.09.2012, Annexure P12, on the ground of delay and latches. Very same orders as challenged in this writ petition i.e., orders dated 16.09.2005 and 12.05.2007 were subject-matter of challenge in the earlier writ petition.

Contention raised by the petitioner is that subsequent thereto, OMKAR SINGH 2016.01.05 16:06 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.26696 of 2015 [2] National Commission for Scheduled Castes vide order dated 10.10.2013, Annexure P15 has recommended that petitioner be considered for promotion from the year 2002 after withholding of promotion for one year in terms of Rule 67(c) of the SBI Officers Service Rules.

On a specific query, learned counsel for the petitioner fairly admits that dismissal of his writ petition on 03.09.2012 was never brought to the notice of National Commission for Scheduled Castes for the reason that complaint before the Commission was pending since 2008. Present writ petition is clearly misconceived and not maintainable in the facts and circumstances as above, which is accordingly dismissed without any order as to costs.
