Widow, two daughters and three sons had filed the claim petition on account of death of Umesh Maddeshiya alias Umesh Kumar, who had admittedly died in a motor vehicular accident. The Tribunal vide award dated 01.12.2023 had awarded an amount of 13,49,346/- as ₹ compensation along with interest to the claimants No.1, 2 and 4 to 6. 2.

It has been jointly submitted during the course of arguments that the matter has been settled vide detailed settlement agreement dated 26.02.2026 before the Mediation and Conciliation Centre of this Court. The said agreement has been placed on record. It is submitted that as per the said agreement, an additional compensation of 70,000/- over and above the ₹ amount which has been awarded by the Tribunal is to be paid by respondent No.2 to the appellants. It is submitted that the said agreement has been entered into voluntarily.

Keeping in view the abovesaid facts and circumstances and on account of the joint statement made by the counsel for the appellants and the counsel for the Insurance Company, the present appeal is partly allowed and the award dated 01.12.2023 passed by the Motor Accidents Claims Tribunal is modified and respondent No.2-Insurance Company is directed to pay an amount of 70,000/- as additional compensation to appellant No.1-Asha ₹ Devi within a period of 45 days from today in accordance with the terms of the settlement, as full and final settlement.
