It is submitted that similarly situated employees have been given arrears of pay subsequent to refixation of their pay. Same benefit has illegally been denied to the petitioner.

However, faced with the difficulty of a specific rider in order dated 09.04.2013, Annexure P3 to the extent that salary of the petitioner is fixed on notional basis and he would not be entitled to arrears prior to 08.05.2009 and the fact that this stipulation has never been challenged by the petitioner, learned counsel seeks to withdraw this writ petition with liberty to file afresh while impugning the same as well.

Dismissed as withdrawn with liberty as aforesaid. ( LISA GILL ) December 21 , 2015.
