NIDHI GUPTA, J. (ORAL) Prayer in this 1st petition filed under Section 483 of Bharatiya Nagarik Suraksha Sahinta, 2023 (BNSS), is for grant of regular bail to the petitioner in case FIR No. 35 dated 14.04.2024 (Annexure P-1) registered under Section 354-A IPC and Section 10 of the Protection of Children from Sexual Offences Act, 2012 at Police Station Mohkampura, Amritsar, Punjab..

Learned counsel for the State has filed custody certificate dated 24.07.2024 which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 03 months and 08 days.

After arguing for some time, when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel submits that he may be permitted to withdraw the instant petition, at this stage.

Permitted to do so.
