The present writ petition has been filed under Articles 226/227 of the Constitution of India praying for issuance of a writ in the nature of certiorari for quashing the office order (Annexure P-4) passed by respondent No.5 vide which the pray of petitioner was refixed by way of withdrawing the increments granted to the petitioner on 02.08.2000 after his retirement on 31.05.2021. Further praying for issuance of a writ in the nature of mandamus directing the respondents to grant the due increment to petitioner on account of his promotion as Junior Engineer in the year 2000 and also the pay the accrued arrears of pension and other retiral benefits to
petitioner along with interest @ 18% p.a. from the date of accrual till the actual realization of the same.

Learned counsel for the petitioner, at this stage, submits that he would be satisfied if a direction is issued to respondent No.3 to consider and decide the legal notice dated 04.05.2026 (Annexure P-7) by passing a reasoned and speaking order within a time-bound period. 3.
On advance notice, Ms. Archana, Advocate, accepts notice on behalf of the respondent and has filed a reply in Court today, which is taken on record. Registry is directed to place the same at an appropriate place on the case file. Learned counsel for the respondents has raised a preliminary objection regarding the maintainability of the present writ petition. However, she submits that she has no objection in the event a direction is issued to respondent No.3/competent authority to consider and decide the legal notice dated 04.05.2026 (Annexure P-7) by passing a reasoned and speaking order within a stipulated period.

In view of the limited prayer made by counsel for the petitioner without commenting upon the merits of the case, the present petition is disposed of and the respondent No.3/competent authority is directed to hear and decide legal notice dated 04.05.2026 (Annexure P-7) by passing a speaking order in a time bound manner within a period of three months from the date of receiving a certified copy of this order. Further the decision taken thereof shall be conveyed to the petitioner.

Needless to say, if the petitioner is found entitled to the relief sought, the same be granted forthwith by respondent/competent authority. 6.
Pending miscellaneous application(s), if any, shall also stands disposed of.
