S.J. VAZIFDAR, ACTING CHIEF JUSTICE (Oral):

The petitioner had made a representation by his letter dated 18.10.2015 against certain private parties. The private parties, however, have not been impleaded. The petitioner has not addressed any notice to these private parties either. However, if the construction is illegal, the respondents are bound to take action in accordance with law.

In the circumstances, the petition is disposed of by directing the respondents to take necessary action in respect of the alleged illegal construction in accordance with law. It is clarified that we express no view regarding the correctness of the allegations in the petition. Needless to add that the respondents would consider the representations of all the concerned parties including the petitioner and the private parties, who are allegedly putting up construction illegally. If the respondents find the construction to be illegal, they are not only entitled but bound to take immediate corrective measures.
