Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Robinson in case FIR No. 117 dated 16.08.2017, registered under Section(s) 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Lambra, District Jalandhar Rural.

As per facts of the case, petitioner was earlier admitted to regular bail and he had been regularly appearing in the Court, but his bail was cancelled on account of his non-appearance on 04.07.2019 and thereafter, he had moved an application for bail before the learned trial Court after about a week's time, but the same was dismissed vide order dated 17.07.2019. Learned counsel for the petitioner contended that petitioner is ready to surrender before the learned trial Court; to furnish fresh bail bonds and surety bonds and shall regularly appear before the learned trial Judge during the course of trial.

On asking of the Court, Mr. Ramandeep Sandhu, Senior Deputy Advocate General, Punjab accepts notice on behalf of respondent. A copy of paper-book be provided to him during the course of the day. Having considered the submissions made by learned counsel for the petitioner and the fact that petitioner was earlier admitted to bail, which was cancelled on account of single default of his non-appearance and thereafter, he himself had moved an application for granting him bail, present petition stands disposed of. It is directed that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for granting him regular bail, the learned trial Judge shall admit him to regular bail on his furnishing fresh bail bonds and surety bonds. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C. against the petitioner. (Shekher Dhawan) Judge August 19, 2019 "DK"
