Present:

Mr. Vikram Singh, Advocate for the petitioner. RAKESH KUMAR JAIN, J (ORAL) This petition is filed against the appointment of Chowkidar by the Sub Divisional Officer (Civil), Karnal exercising the powers of Collector.

Although learned counsel for the petitioner has submitted that the Commissioner has committed an error in dismissing the appeal on the ground that there is no provision of appeal, yet during the course of hearing, he has admitted that in the Haryana Chowkidara (Watchman) Rules 2011 notified on 11.1.2013, right of appeal is not provided.

In view of this, the arguments of the petitioner is without any consequence. However, he has been heard on merits against the order of appointment of the private respondent as Chowkidar. Although learned counsel for the petitioner has argued vehemently that the private respondent has wrongly been appointed but after taking into the facts and circumstances of the

CWP No.22238 of 2017 #2# present case, I find that the Collector has found Naresh Kumarrespondent No.4 to be meritorious than the petitioner clearly having an edge over him, therefore, I do not find any reason to interfere with this decision.

Dismissed.
