It is not possible at this stage to entertain the grievance raised in this petition to the effect that the work was not allotted to the petitioner.

The petitioner states that the work has not been allotted to any party as yet. The petitioner has not invited our attention to any communication rejecting the petitioner's bid. Annexure P/5 is only one of the bid documents. The petition does not disclose the other documents which would be necessary for the petitioner to establish that his bid was technically qualified for the award of the contract. For instance, there is nothing that indicates the average annual financial turnover during the last three years to be at least Rs.50 lacs as required by Clause 19.i of the NIT. The petitioner ought, in the first instance, to address a letter to the respondents seeking clarification as to whether the bid is rejected or not. In the event of such a letter being written, the respondents shall respond forthwith.
