The petitioner through instant petition under Article 226 of the Constitution of India is seeking setting aside of order dated 26.11.2021 whereby respondent No.3-Vice Chancellor, Panjab University has set aside his election to the senate from the 'Teachers of Affiliated Arts Colleges' constituency. He is further seeking declaration that he continues to be a teacher of an affiliated college and is eligible to be enrolled as a voter and file his nomination as a candidate. He is also seeking direction to respondent No.2-Chancellor, Panjab University to decide his representation dated 05.12.2021 as well as direction to respondent Nos.1 to 4 to permit him to file his nomination for senate election scheduled for September' 2026. He is also praying that operation of the impugned order dated 26.11.2021 may be kept in abeyance.

The petitioner on 21.08.2014 was appointed as Assistant Professor (Political Science) at an affiliated College (SPN College, Mukerian) of respondent No.1-Panjab University. He was terminated vide order dated 23.06.2021. The termination order dated 23.06.2021 was set MOHIT KUMAR 2026.05.27 15:19 I attest to the accuracy and authenticity of this order/judgment.

CWP-17399-2026 -2aside by respondent-University and he by way of order dated 16.07.2021 was reinstated. The College approached this Court by way CWP No.13568 of 2021 assailing reinstatement order dated 23.06.2021 which is pending adjudication. He contested in the elections for senate and came to be elected from 'Teachers of Affiliated Arts Colleges' constituency. His eligibility to contest election was assailed before this Court by way of CWP No.21413 of 2021 which vide order dated 02.11.2021 was disposed of with a direction to respondent No.3-Vice Chancellor, Panjab University to decide the representation. Respondent No.3 vide order dated 26.11.2021 rejected his eligibility for participation in the senate election on the ground that he was not a teacher in any of the colleges of the respondent-University after 23.06.2021.

He filed an appeal dated 05.12.2021 to the respondent No.2Chancellor assailing order dated 26.11.2021 but the same has not been addressed till date. He preferred reminder dated 29.04.2026 to the respondents to decide his appeal and permit him to file nomination for elections scheduled for September' 2026 but to no avail. 3.

Learned counsel for the petitioner seeks permission to withdraw the petition with liberty to file afresh with better particulars. 4.
