JASWANT SINGH, J. (ORAL) The petitioner stands retired on 31.07.2018 from the rank of Assistant Junior Engineer (Communication) on attaining the age of 58 years. The petitioner is stated to be a handicapped employee with 50 per cent disability.
The grievance of the petitioner is that vide impugned speaking order dated 30.07.2018 (Annexure P-12), his claim for extension in service has been declined on absolutely absurd ground. CWP-20538-2018 (O&M) of office order dated 29.10.2018, has been produced wherein it is stated that petitioner on attaining the age of superannuation of 58 years was retired w.e.f. 31.7.2018, however, following the filing of the instant writ petition the matter was reconsidered and order dated 1.6.2018 vide which petitioner was retired has been cancelled and he has been reinstated in service with immediate effect upto the age of 60 years under handicapped quota and the period from 1.8.2018 to the date of joining shall be treated as duty period with all consequential benefits. Copy of office order dated 29.10.2018 is taken on record.
In view of the above, counsel for the petitioner concedes that nothing more survives for adjudication in the instant writ petition. Dismissed as infructuous. It is ordered that the salary for the intervening period shall be released within two months from today as he has remained out of service w.e.f. 1.8.2018.
