At the outset, learned State counsel, who is appearing on advance notice submits that the petitioner himself along with his brother is facing allegations of causing grievous injury to respondent No.5. 2.
Further submits that instead of facing the proceedings or explaining his circumstances at appropriate forum, the present petition has been filed by the petitioner before this Court under Section 528 of BNSS, 2023, for seeking directions to official respondents to look into the matter and to take appropriate action for conducting investigation in case FIR No.0026, dated 01.03.2024, under Sections 323, 325, 506, 34 of IPC, registered at Police Station Mullanpur, District SAS Nagar. 3.
Faced with the situation, learned counsel for the petitioner prays for withdrawal of present petition with liberty to avail alternative remedy, if any, available under the law.
