RAJESH BHARDWAJ, J.(ORAL) Present petition has been filed under Section 528 of Bharatiya Nagrik Suraksha Sanhita, 2023 for issuance of direction to respondents to submit/furnish copy of FSL report, in relation to the death of husband of the petitioner, which allegedly occurred under suspcious circumstances on 25.02.2024 and in reference whereof one DDR No.17, dated 25.02.2024 was registered by the respondents and despite lapse of four months, the respondents have failed to establish the actual cause of death. It has been submitted by learned counsel for the petitioner that petitioner is facing prosecution in case FIR No.65, dated 26.02.2024 under Sections 354/34 IPC and 8/17 of the POCSO Act, at Police Station Civil Lines, Sonipat. He submits that case is at the evidence stage, however, FSL report has not been submitted before the Court till date. CRM-M-35753-2024(O&M) -2On asking of the Court, Mr.Sumit Jain, Additional Advocate General, Haryana, who is present in Court, accepts notice on behalf of the respondent/State and submits that FSL report is yet to be received and on receiving the same, the same would be presented before the Court of competent jurisdiction.

In view of the statement made by learned State counsel, the present petition is disposed of with a direction to the respondent/State that FSL report be called expeditiously preferably within a month from today and on receiving the said report, the same be presented before the Court of competent jurisdiction for further necessary action, as in accordance with law.
