State of Haryana and others .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Nipun Vashist,Advocate for the petitioner Jaswant Singh,J.(Oral) One of the unsuccessful candidates for the office of Lambardar of Village Dulhera Khurd has filed the present petition assailing the order dated 10.1.2014 passed by revisional authority/ Financial Commissioner, Haryana whereby appointment of Raj Kishore-respondent no.4 to the office of Lambardar has been restored by reversing the order dated 25.4.2013(P-2) passed by Commissioner, Gurgaon Division while restoring the orders passed by the authorities below including Collector, Rewari.

Having heard learned counsel for the petitioner this Court finds no ground to interfere with the impugned order. Collector Rewari considered the Naksha Lambardar and merits and demerits of all the candidates and found that Raj Kishore was the only candidate residing in the Village and had support of respectables of the Village and therefore, more suitable. CWP 2689/2015 not in good financial condition does not mean that he is under any debt. The revisional authority has noticed that the village comprises of 90% population belonging to Scheduled Caste and Raj Kishore being a member of the said community would effectively discharge the functions of his office. Apart from that nothing has been placed on record to rebut the finding that Malik Raj is not a resident of the Village and resides in Bawal.

In view of the above,finding no merit in this writ petition the same is hereby dismissed.
