CORAM:HON'BLE MS. JUSTICE JAISHREE THAKUR

Present:

Mr. Vikas Lochab, Advocate for the petitioner.

Mr. Pawan Sharda, Sr. DAG, Punjab.

Mr. Harbans Sharma, Advocate for respondent No.4.

-.- JAISHREE THAKUR J. (ORAL) The instant writ petition has been filed under Article 226/227 of the Constitution of India seeks implementation of the award of the Arbitrator, which was passed as far back as 12.07.2007. Learned counsel appearing on behalf of the respondent No.4 would submit that the petitioner is at liberty to avail an appropriate remedy under Section 63(c) of the Punjab Cooperative Societies Act, 1961. I have heard learned counsel for the parties and find that the instant writ petition would not be maintainable, in view of the fact that the petitioner has not availed the remedy as provided under the 1961 Act, which he ought to have done at the very first instance. Consequently, the instant petition stands disposed of by giving liberty to the petitioner to approach the competent authority under Section 63(c) of the 1961 Act.
