JUSTICE AMIT RAWAL -.- AMIT RAWAL J.(ORAL) The petitioners are aggrieved of the impugned order whereby the water course ABCD along with western side of killa No.18 and 23, rectangle No.149 in the village Pegan has been ordered to be restored. The aforementioned order has been passed on the basis of spot inspection and report of the Ziledar.
The contention of Mr. Jasbir Mor, learned counsel appearing on behalf of the petitioner that the water course as per site plan was never in existence, has been belied before the authorities as the water course was in existence since consolidation. The aforementioned fact has been noticed by taking into consideration in the revenue record, in essence, the provisions of Section 2(15) of the Haryana Canal and Drainage Act, 1974 have been complied with.
In my view, the orders under challenge are perfectly legal and justified and do not call for any interference, much less, doctrine akin to judicial review. No ground for interference is made out. The writ petition is dismissed.
