(ORAL) By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to consider the case for release of family pension accrued to him on account of sudden demise of his father namely Jagdish Ram s/o Dhani Ram working in the office of respondent No.3 as Motor Grader Operation (Regular).

In response to the notice of motion issued by this Court, respondents have filed short reply by way of affidavit of Mr. Paras Ram, Executive Engineer, Communication Division, Ranjit Sagar Dam Project, Shahpurkandi Township Distict Pathankot on behalf of respondents No. 1, 3 and 4. Paragraphs No. 3 and 4 are relevant for the disposal of the instant petition, which read as under:- "3.

That upon the receipt of requisite documents from Sonika 2018.05.18 12:44 I attest to the accuracy and authenticity of this document Chandigarh

the petitioner, the family pension case of the petitioner was submitted to the office of Accountant General, Punjab, Chandigarh i.e. respondent No.2, being the competent authority and the same has been sanctioned by the office of Accountant General, Punjab, Chandigarh vide No. Pen/7J9/2001-2002/368-70, dated 12.05.2016 @Rs.1800/- from 19.07.2002 up to the age of 25 years or get married or he starts his livelihood whichever is earlier. The date of birth of the petitioner is 08.05.1994 (copy of letter dated 12.05.2016 is annexed as Annexure R-1) 4.

That upon sanction of family pension by the Accountant General, Punjab, Chandigarh in favour of petitioner, District Treasury Officer, Hoshiarpur, further sent the case to Central Bank of India, Branch Datarpur in District Hoshiarpur, for payment of family pension and its arrear. Bank Authority has prepare arrear amounting to Rs.9,99,900/- on submission of required documents by the petitioner dated 22.08.2016 and entered into system for feeding in the Account No.3541361889 of the petitioner on dated 23.08.2016, copy of letter issued by the Bank, which has been opted by the petitioner for family pension & arrear is enclosed herewith as Annexure R-11."

A glance at the aforesaid paragraphs makes it crystal clear that demand raised by the petitioner has since been accepted and family pension along with arrears thereof has been released to him. 5.

In the light of aforesaid facts and circumstances, instant petition stands disposed of as having been rendered infructuous.
